Welcome to Brush. By using our service, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Brush application and website, operated by Brush Social L.L.C. ("Brush," "we," "us," or "our"). By accessing or using Brush, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use our service.

2. Eligibility

  • You must be at least 18 years old to use Brush
  • You must provide accurate and complete information
  • You are responsible for maintaining account security

3. User Conduct

You agree NOT to:

  • Harass, abuse, or harm other users
  • Use Brush for illegal purposes
  • Impersonate others or provide false information
  • Spam or send unsolicited messages
  • Attempt to circumvent our safety features
  • Share inappropriate or offensive content

4. Safety & Interactions

  • All interactions require mutual consent
  • Meet in public places when meeting in person
  • You're responsible for your own safety decisions
  • Report any concerning behavior immediately

5. Child Safety & Legal Compliance

Zero tolerance. Brush has a zero-tolerance policy for Child Sexual Abuse Material (CSAM), child sex trafficking, and the online enticement of minors. You are strictly prohibited from uploading, sharing, or storing such content.

Mandatory reporting. As required by federal law (18 U.S.C. § 2258A), we will immediately report any actual knowledge of apparent child exploitation to the National Center for Missing & Exploited Children (NCMEC) CyberTipline. A report may include: your username, email address, and account registration details; your IP address, date/time stamps (including time zone), and device information associated with the activity; and the original content and any associated text, comments, or communications.

One-year data preservation. Under the REPORT Act, Brush is legally required to preserve all images and technical data related to a CyberTipline report for at least one year from the date of the report. This preservation overrides any request to delete your data or any "right to be forgotten" with respect to that reported matter.

Waiver of privacy. By using Brush, you acknowledge and agree that you waive any expectation of privacy regarding content that violates child exploitation laws. We may share such data with NCMEC and authorized law enforcement agencies without further notice to you.

6. Intellectual Property

All content and features on Brush are owned by us. You retain rights to your content but grant us a license to use it for providing the service.

7. Termination

We may suspend or terminate accounts that violate these terms. You can delete your account anytime through settings. Data that we are legally required to preserve (e.g., in connection with a report under Section 5) will be retained as required by law.

8. Disclaimers

  • Brush is provided "as is" without warranties
  • We don't guarantee specific outcomes or connections
  • We're not responsible for user behavior or content

9. Limitation of Liability

To the maximum extent permitted by law, Brush shall not be liable for any indirect, incidental, special, or consequential damages.

10. Governing Law

These terms are governed by the laws of New York State, without regard to conflict of law principles.

11. Changes to Terms

We may update these terms occasionally. We'll notify you of significant changes via email or in-app notification.
